SASOM TERMS & CONDITIONS

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and SASOM Co., Ltd. (“SASOM”, the “Company”, “we”, “us”, or “our”) governing your access to and use of our website (including sasom.co.th), our mobile application, and any related functions, content, or services (collectively, the “Platform”). By accessing or using the Platform in any manner, you agree to be bound by these Terms and the policies incorporated by reference.
0. Definitions
0.1 “Account” means an individual or business account registered on the Platform.
0.2 “User” means any natural or juristic person who accesses or uses the Platform in any capacity, including as Buyer or Seller.
0.3 “Buyer” means any User who places a bid, buy order, or pre-order, or otherwise purchases products via the Platform.
0.4 “Seller” means any User who places an ask order, sell order, or otherwise lists or supplies products via the Platform, including under the SASOM Storage program.
0.5 “Bid Order” means an order placed by a Buyer indicating willingness to purchase a specified product at a specified price and conditions.
0.6 “Ask Order” means an order placed by a Seller indicating willingness to sell a specified product at a specified price and conditions.
0.7 “Transaction” means a binding sale and purchase agreement formed between a Buyer and a Seller through the Platform when a Bid Order and Ask Order (or Buy Order and Sell Order) match, or when a Pre-order is confirmed.
0.8 “Service Fees” means all fees, commissions, payment processing fees, storage fees and any other charges that SASOM may impose as published on the Platform from time to time.
0.9 “Product Guideline” means SASOM’s product and condition standards and explanatory materials published on the Platform, as amended from time to time.
0.10 “Authentication Guarantee” means SASOM’s process and commitment regarding authenticity checks on eligible products as further described in these Terms.
0.11 “Storage Program” or “SASOM Storage program” means SASOM’s storage and listing service whereby Sellers send products to SASOM for storage, inspection and sale, as further described herein.
0.12 “SASOM Points” and “SASOM Tier Points” mean loyalty and membership-related points and tiers as described in Section 12.
1. Preface
1.1 Welcome to SASOM. These Terms govern your access to and use of the Platform whether via sasom.co.th and/or the SASOM mobile application. Before using any SASOM services, you must read these Terms together with the SASOM User Agreement (these Terms), Privacy Policy, Help Center, Discount Policy, and Penalty Policy (together, the “SASOM Policies”). Your use of the Platform constitutes your full acceptance of all SASOM Policies. If you do not agree with any part of the SASOM Policies, you shall immediately cease use of the Platform.
1.2 SASOM operates the Platform as an online marketplace that serves as a destination for collectors and facilitates the buying and selling of specified products. SASOM’s role is limited to providing the Platform and facilitating Transactions. The actual sale and purchase contract for products is formed directly between the Buyer and the Seller, except where explicitly stated that SASOM acts as seller.
1.3 SASOM shall not be responsible for any damage, loss or claim arising out of Transactions except where such damage is expressly covered by SASOM’s Authentication Guarantee or is required by applicable law. SASOM’s responsibilities in relation to products are limited to: (a) facilitating the Transaction and logistics flow, and (b) performing authenticity checks on eligible products for the purpose of the Authentication Guarantee.
1.4 For purposes of these Terms, “the Company” shall mean SASOM Co., Ltd.
1.5 SASOM does not guarantee that any Transaction will be successfully completed. All Transactions remain subject to, among other things, payment processing, stock availability, and successful authentication (where applicable).
1.6 SASOM does not guarantee the timing of any Transaction, including the time required to match orders, inspect products, process payments, or complete delivery. Any timelines given on the Platform are estimates only.
1.7 If you are under 18 years of age or under the age of legal capacity in your jurisdiction, you may use the Platform only with the consent and supervision of a parent or legal guardian. Where a parent or guardian agrees to these Terms on your behalf, such parent or guardian shall be fully responsible and liable for all actions taken via your Account.
1.8 SASOM reserves the right at any time to change, modify, suspend, or discontinue any part of the Platform or services, or to remove or modify functionalities, with or without notice. SASOM shall not be liable for any loss or damage arising from such actions, except where required by applicable law.
1.9 SASOM reserves the right, at its sole discretion and without the need to provide reasons, to refuse access to or use of the Platform or to refuse to open an Account for any person.
2. Services and Acceptable Use
2.1 Access to the Platform and SASOM’s services is limited to Users who have agreed to be bound by these Terms (and where applicable, whose parents/guardians have agreed on their behalf).
2.2 Users whose Accounts are suspended, whether temporarily or permanently, are not permitted to use SASOM’s services until suspension is lifted.
2.3 You hereby agree that you shall:
2.3.1 Use the Platform strictly in accordance with these Terms and the SASOM Policies.
2.3.2 Use the Platform only for lawful purposes and through lawful means.
2.3.3 Not violate any applicable laws or regulations, including without limitation export and import control laws.
2.3.4 Not use the Platform for the purpose of fraud, dishonesty, misrepresentation, deception, or any conduct that infringes upon the rights of other Users or third parties.
2.3.5 Not impersonate any person or juristic person, or misrepresent your affiliation with any person or juristic person.
2.3.6 Not engage in any act of price manipulation or market distortion on the Platform.
2.3.7 Not collect, harvest, or otherwise obtain information about other Account holders, including personal information, without lawful basis and SASOM’s consent where required.
2.3.8 Not access or attempt to access any data or system to which you are not authorized.
2.3.9 Not access the Platform by using an emulator, simulator, bot, automated script, scraper, or any other non-human interface, except where expressly permitted by SASOM in writing.
2.3.10 Not interfere with, disrupt, alter or hinder the Platform, its servers, networks, or other Users’ enjoyment of the services, including without limitation hacking, denial of service, or similar attacks.
2.3.11 Not use the services to violate or evade sanctions or trade prohibitions imposed or enforced by the authorities of Thailand, the United States (including OFAC), the European Union, the United Kingdom, the United Nations, or any other competent authority.
2.3.12 Not infringe upon any rights of SASOM, including contractual and intellectual property rights.
2.3.13 Not use SASOM’s intellectual property without SASOM’s prior permission.
2.3.14 Not upload, post, transmit or make available content that is illegal, threatening, harassing, inciting panic, deceptive, defamatory, disrespectful, profane, slanderous, invasive of privacy, obscene, disgusting, or discriminatory, including racist or hate-motivated content.
2.3.15 Not upload, post, transmit or otherwise provide any content involving minors who are not under proper guardianship or use the Platform in any way that harms or exploits minors.
2.3.16 Not remove, alter, or obscure any ownership notice or proprietary legend on the Platform or any SASOM materials.
2.3.17 Not take any action intended to undermine, interfere with, or exploit SASOM’s systems, including but not limited to working systems, points and rewards systems, or any other SASOM system.
2.3.18 Not upload, post, describe, email, transmit or publish any confidential or proprietary content that you are not authorized to disclose under law, contract, or fiduciary relationship (including internal information subject to non-disclosure obligations).
2.3.19 Not upload, post, describe, email, transmit or publish content that infringes trademarks, trade secrets, copyrights or other proprietary rights of third parties.
2.3.20 Not upload, post, describe, email, transmit or distribute unsolicited or unauthorized communications, including but not limited to junk mail, spam, chain letters, pyramid schemes, or other forms of unauthorized solicitation.
2.4 You acknowledge that you alone are responsible for all content and materials that you upload, describe, email, post, forward, disclose or otherwise make available on or through the Platform. SASOM shall not be liable for any damage arising from such user-generated content or materials.
2.5 You understand that SASOM does not and cannot pre-screen all content posted by Users and that you may encounter content that is offensive, obscene or objectionable. You assume all risks associated with reliance on the accuracy, completeness or usefulness of such content. To the maximum extent permitted by law, you agree not to rely on content accumulated on the Platform, including but not limited to community content, discussion forums and other areas of the site, as a substitute for your own judgment.
2.6 If you encounter content that you consider offensive or that you believe violates these Terms, you may notify SASOM via support@sasom.co.th or through other contact channels indicated on the Platform.
2.7 You acknowledge and agree that SASOM may access, preserve and disclose your Account information and content if required to do so by law, court order, governmental authority or competent regulator, or if SASOM has a good-faith belief that such access, preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms; (c) respond to claims of rights infringement; (d) respond to your customer service requests; or (e) protect the rights, property or safety of SASOM, Users or the general public.
2.8 Prices listed on the Platform are, unless expressly stated otherwise, deemed to be inclusive of applicable taxes or to be subject to tax as specified on the Platform or at checkout.
2.9 SASOM may implement fraud-prevention and risk-management measures, including but not limited to device fingerprinting, IP-address checks, transaction risk scoring, identity verification (KYC), address verification, temporary holds on payouts, and suspension of Transactions pending investigation.
3. Privacy
3.1 SASOM places great importance on the privacy of Users. Details regarding how SASOM collects, uses, discloses and protects personal data are set out in SASOM’s Privacy Policy, which is available on sasom.co.th and within the SASOM mobile application.
3.2 By agreeing to these Terms and by using the Platform, you also agree to be bound by SASOM’s Privacy Policy.
3.3 You acknowledge that certain ownership rights in user data are shared between you and SASOM to the extent necessary for SASOM to operate the Platform, maintain security, enforce these Terms, comply with law, and develop and improve services.
3.4 SASOM will comply with applicable personal data protection laws. You may request access to and/or deletion of your personal information in accordance with applicable law and SASOM’s Privacy Policy. Certain data may be retained as required by law or for legitimate interests such as fraud prevention or dispute resolution.
3.5 SASOM may use aggregated and anonymized data (which does not identify you personally) for analytics, market insight (including price indices and trend analysis), service improvement and sharing with partners for fraud prevention or service enhancement. SASOM will not sell personally identifiable information in violation of applicable law.
4. Intellectual Property
4.1 All intellectual property rights in and to the Platform, including but not limited to software, source code, design, layout, compilations, text, images, logos, trade names, trademarks, service marks, and other content, are owned by SASOM and/or its licensors or partners. SASOM reserves all such rights to the fullest extent permitted by law.
4.2 You shall not, without SASOM’s prior written consent or the consent of the relevant rights holder, copy, duplicate, reproduce, reverse engineer, decompile, disassemble, modify, adapt, distribute, republish, display, broadcast, mirror, link, transfer, transmit or store any part of the Platform in any information retrieval system or server, or use it on any system or device, except as expressly permitted in these Terms.
4.3 Subject to your continued compliance with these Terms, SASOM grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for your personal and non-commercial purposes.
4.4 SASOM permits you to download or print materials from the Platform for personal use only, without modification and not for commercial exploitation of any kind.
4.5 Users are independent from SASOM. SASOM is not an agent or representative of Users and does not own or possess products listed on the Platform unless expressly stated otherwise.
4.6 If you are an intellectual property rights owner or a duly authorized agent and you believe that any content on the Platform infringes your rights, you may notify SASOM in writing at support@sasom.co.th with sufficient documentation to support your claim. SASOM will process such claims within a reasonable time.
4.7 You shall not use any automated system (including bots, spiders, crawlers, scrapers) to access the Platform for the purpose of extracting data or training models without SASOM’s prior written consent.
5. Account and Security
5.1 To use most features of the Platform, you must register an Account with SASOM by using your email as a user ID, or by logging in via supported social accounts (including Facebook, Apple and Google).
5.2 You agree to keep your Account credentials (username and password) strictly confidential and not to share them with any third party.
5.3 You agree to ensure that all information provided in your Account is accurate, current and complete and to promptly update such information as necessary.
5.4 You shall use an appropriate and non-offensive nickname. If SASOM determines that a nickname is inappropriate or in breach of these Terms, SASOM may amend the nickname or suspend your access to some or all services without prior notice.
5.5 You shall immediately notify SASOM if:
(a) you are unable to access your Account; or
(b) you believe your Account has been accessed or used by an unauthorized person.
5.6 SASOM shall not be liable for any loss or damage arising from unauthorized use of your password or Account. To reduce the risk of password compromise, SASOM recommends that you change your password on a regular basis.
5.7 SASOM reserves the right to suspend and/or terminate your Account without prior notice if:
(a) you have violated these Terms or any SASOM Policy;
(b) you hold more than one Account for unlawful or abusive purposes;
(c) your Account has been inactive for an extended period, as determined by SASOM; or
(d) your actions cause or are likely to cause detriment to SASOM or SASOM’s property or reputation.
5.8 You may cancel your Account by sending a written request to support@sasom.co.th. You remain responsible for any uncompleted Transactions and for the consequences of prior Transactions. SASOM shall not be responsible for any damage arising from its execution of your Account cancellation request, and you waive any claim against SASOM in connection with such cancellation, to the maximum extent permitted by law.
5.9 You may open an Account and/or use the services only if you reside in a country where SASOM operates or where such use is legally permitted.
5.10 SASOM may retain certain Account and Transaction data after Account cancellation or termination as required by law or for legitimate business purposes, including fraud prevention and dispute resolution.
6. Penalties for Violations of Service Conditions
6.1 If SASOM determines that you have violated these Terms or any SASOM Policy, SASOM may, at its sole discretion, take one or more of the following actions, without limitation:
6.1.1 Issue a warning;
6.1.2 Cancel Transactions in progress;
6.1.3 Cancel all live offers;
6.1.4 Temporarily suspend payments to you;
6.1.5 Temporarily suspend your access to the Platform or services;
6.1.6 Permanently terminate your Account and access to services;
6.1.7 Impose limits on your Account privileges;
6.1.8 Impose fines or penalties as specified in the Penalty Policy;
6.1.9 Initiate civil proceedings;
6.1.10 Initiate criminal proceedings, where applicable.
6.2 If you believe that another User has violated these Terms, you may inform SASOM using the contact channels provided in Section 16.
6.3 If you believe that you have been wrongly penalized, you must notify SASOM within fifteen (15) days of the date on which the penalty was imposed.
6.4 If you believe that your credit or points have been wrongly deducted or calculated, you must notify SASOM within fifteen (15) days of the relevant calculation date.
7. Buy and Bid
7.1 Buyers may place Bid Orders indicating willingness to buy specified products at specified prices. SASOM may display Bid Orders to other Users, including information such as price, size, model, brand and product type.
7.2 SASOM will match Transactions when Bid Orders and Ask Orders meet the relevant conditions. SASOM will notify the Buyer when a Bid Order has been successfully matched. If payment cannot be processed for any reason (including but not limited to insufficient credit limit or card cancellation), SASOM may cancel the Bid Order and shall have no obligation to complete the Transaction.
7.3 A binding purchase contract between Buyer and Seller is formed when: (a) a Buyer’s Bid Order is matched with a Seller’s Ask Order; or (b) a Buyer places a Buy Order that matches an Ask Order.
7.4 Buyers may place Buy Orders to instantly purchase items against existing Ask Offers.
7.5 The Buyer acknowledges and agrees to the product condition stated on the Platform at checkout. Where the product condition is as stated and consistent with the Product Guideline, the Buyer may not reject the product or raise a claim solely on subjective grounds. If defects beyond SASOM’s criteria are found, SASOM may cancel the Transaction or offer the Buyer the choice to proceed or cancel. If the Buyer does not respond within twenty-four (24) hours, SASOM may deem that the Buyer has agreed to proceed.
7.6 Buyers and Sellers may refer to SASOM’s Product Guideline. SASOM shall not be responsible for misunderstandings regarding product condition when such condition is properly described under the Product Guideline.
7.7 Buyers must provide accurate and up-to-date shipping address information. SASOM shall not be liable for any loss or damage arising from inaccurate or falsified shipping information provided by the Buyer.
7.8 Instructions on how to place bids, buy orders and delivery details are available in the Help Center.
7.9 If a shipment is returned by the logistics provider due to reasons attributable to the Buyer, the Buyer shall bear all resulting return costs and fees.
8. Ask and Sell
8.1 Sellers may place Ask Orders indicating willingness to sell specified products at specified prices. SASOM may display Ask Offers to other Users, including price, size, model, brand and product type.
8.2 Sellers may place Sell Orders to accept existing Bid Offers.
8.3 A binding sales contract between Buyer and Seller is formed when: (a) a Seller’s Ask Order is matched with a Buyer’s Bid Order; or (b) a Seller places a Sell Order that matches a Buyer’s Bid Order.
8.4 Once the Buyer has successfully made payment to SASOM, SASOM will notify the Seller to proceed according to the shipping and confirmation requirements.
8.5 The Seller shall confirm the order within one (1) day from SASOM’s notification and shall ship the product to one of SASOM’s designated logistics partners within two (2) days from such notification, subject to applicable exceptions (e.g., public holidays). SASOM reserves the right to impose penalties on late shippers in accordance with the Penalty Policy.
8.6 Sellers acknowledge that SASOM only permits authentic products on the Platform and that SASOM treats authenticity very seriously. If a product cannot be confirmed as authentic, SASOM may impose penalties on the Seller, including reduced privileges and benefits, as further described in the Penalty Policy.
8.7 Sellers must ensure that products meet SASOM’s standards as described in the Product Guideline and Help Center and must clearly state product condition when listing. If condition is not specified, the product may be deemed to be in perfect condition. In case of disputes, SASOM may reduce payouts, return products, cancel items, impose fines or take other remedial measures.
8.8 The Seller bears all risk in relation to shipment of the product to SASOM for inspection and is responsible for adequate insurance coverage for loss or damage during this stage. SASOM is not liable for loss or damage occurring before the product reaches SASOM. SASOM shall only be responsible, subject to these Terms, for damage occurring during shipment from SASOM to the Buyer.
8.9 The Seller must provide correct and up-to-date shipping information to SASOM. SASOM shall not be liable for delay or loss due to inaccurate or falsified shipping information provided by the Seller.
8.10 The Seller shall manage and ensure that product details, including price, description, inventory and conditions of sale, are accurate and kept up to date. The Seller shall not post incorrect, incomplete or misleading information.
8.11 The Seller is solely responsible for determining the listing price of products. The price charged to the Buyer is the final price and shall include all applicable taxes such as sales tax, value added tax and customs duties, unless otherwise explicitly stated. The Seller shall not charge the Buyer or SASOM any additional or separate amount outside the Platform.
8.12 The Seller agrees that SASOM may run promotional activities to encourage Transactions (e.g., discounts, vouchers, price reductions). The Seller’s final payout will generally equal the listing price minus SASOM’s Service Fees, payment processing fees and any other applicable fees.
8.13 For promotional purposes, SASOM may list products (with adjusted prices where appropriate) on third-party websites, including portals and price comparison sites, domestically or internationally.
8.14 The Seller shall issue a receipt or tax invoice to the Buyer upon request in accordance with applicable laws and regulations.
8.15 The Seller acknowledges that the Buyer is responsible for paying all customs duties and taxes for goods sold, and that SASOM cannot provide legal or tax advice on such matters. The Seller is encouraged to consult tax advisors as necessary.
8.16 The Seller acknowledges that violation of any SASOM policy, including the Penalty Policy, may result in the actions specified in Section 6.
8.17 If the Seller requires a full tax invoice from SASOM in connection with Service Fees or payouts, the Seller must contact SASOM within three (3) days after receiving the payout.
8.18 If the Seller requires a seller report for tax or accounting purposes, the Seller must contact SASOM within three (3) days after receiving the payout.
8.19 If the Seller participates in the SASOM Storage program, the Seller agrees to:
8.19.1 Send only products belonging to categories permitted under the SASOM Storage program.
8.19.2 Clearly state the product’s model, size and intended price.
8.19.3 List items and submit storage and listing requests through SASOM’s systems.
8.19.4 Ship items in accordance with the predetermined date, time and logistics channel specified by SASOM.
8.19.5 Always include an accurate order list with the shipment. SASOM shall not be responsible for any damage, misplacement or loss arising from missing or incorrect order lists.
8.19.6 If an item fails inspection, SASOM will return it within seven (7) working days, and the Seller shall bear all return costs.
8.19.7 A free storage period of thirty (30) days is provided. After this period, SASOM will notify the Seller to either extend storage or request return of the items. If the Seller does not respond within three (3) days after the expiration date, SASOM may deem that the Seller consents to an extension of storage and the application of storage fees.
8.19.8 Storage and return prices are available on the “In Storage” page of the Platform.
8.19.9 The Seller may receive additional benefits for joining the SASOM Storage program. SASOM reserves the right to change such benefits without prior notice.
8.19.10 SASOM is not liable for minor wear, environmental effects (including humidity, oxidation and hydrolysis) or fluctuations in market value while items are stored. SASOM’s liability for loss of or damage to stored items, if any, is limited in accordance with Section 18.
8.19.11 Where items remain unclaimed for an extended period and SASOM is repeatedly unable to contact the Seller, SASOM may, subject to applicable law and internal policy, take further action including continuing to charge storage fees or disposing of items.
8.20 Seller Ownership and Legality. The Seller represents and warrants that:
(a) the Seller has full legal title and the right to sell each item listed;
(b) no item is stolen or associated with criminal activity; and
(c) items do not infringe third-party rights. SASOM may request proof of purchase or ownership and may withhold payouts, cancel Transactions or suspend Accounts where ownership or legality is in doubt, or where requested by law enforcement.
9. Pre-order
9.1 Only products indicated as eligible may be purchased via Pre-order.
9.2 To confirm a Pre-order, the User must pay either (a) the full amount; or (b) a deposit, in the amount shown on the product page.
9.2.1 Where a deposit is paid, it is the User’s responsibility to ensure that contact information and communication channels registered with SASOM are accurate and kept up to date prior to notification of product arrival.
9.3 Once the deposit has been paid, the Pre-order is deemed confirmed. SASOM will send confirmation via in-app notification and registered email.
9.4 Upon payment of the deposit, the User acknowledges that the deposit is generally non-refundable, except in cases where SASOM cancels the Pre-order under Section 9.7 or where required by applicable law. The User may not unilaterally change, cancel or request a refund of the deposit.
9.5 When the product arrives, SASOM will notify the User via in-app notification and registered email. The User must pay the remaining amount shown on the order page within the period specified by SASOM to complete the order.
9.5.1 It is the User’s responsibility to check notifications and to make payment within the specified period. SASOM will send at least one additional notification before the payment due date. If the User fails to pay the remaining amount within the specified period, SASOM may cancel the Pre-order. In such case, SASOM reserves the right to treat the deposit as forfeited, except where SASOM is required by law to refund it.
9.6 Once the remaining payment has been successfully made and SASOM has received the goods, SASOM will deliver the goods within a reasonable period (currently five (5) working days), subject to force majeure or other events beyond SASOM’s control. Delivery timelines are indicative only and not guarantees.
9.7 SASOM reserves the right to cancel a Pre-order if circumstances beyond SASOM’s control occur, including but not limited to manufacturer inability to supply products as promised or supply shortages. In such case, SASOM will notify the User and refund the deposit within a reasonable time (currently three (3) working days).
9.8 SASOM reserves the right to change, amend or cancel any Pre-order conditions at any time without prior notice for future Pre-orders, including but not limited to the Pre-order period, product quantity, per-Account purchase limits, expected delivery times and deposit amounts.
9.9 Sellers who accept Pre-order sales must fulfill such Transactions in full and on time.
9.10 SASOM reserves the right to allocate or deny participation in Pre-order opportunities at its sole discretion.
10. Services, Fees, Discounts, Privileges and Promotions
10.1 SASOM’s Service Fees are stated on the Platform and/or checkout page. Users must review and understand the applicable fees before using the services. The Service Fee used to calculate Seller charges is the Service Fee applicable on the date the Transaction is matched, not the date the product was listed. Where the Seller Service Fee is increased for reasons unrelated to penalties, SASOM will endeavor to notify Sellers at least fifteen (15) days in advance via the communication channels specified in Section 16.
10.2 SASOM reserves the right to change Service Fees or fee structures at any time.
10.3 By agreeing to these Terms and continuing to use the Platform after changes become effective, Users are deemed to agree to the applicable Service Fees.
10.4 SASOM may issue discount codes, privileges and/or promotions from time to time. The terms applicable to discount codes, privileges and promotions are set out in the Discount Policy, specific privilege pages and/or promotion pages.
10.5 SASOM reserves the right to change the Discount Policy and related terms and conditions without prior notice.
10.6 By agreeing to these Terms, Users are deemed to agree to the Discount Policy.
10.7 SASOM may provide optional services such as cleaning or sole installation. SASOM’s liability for accidental damage arising from such services is limited to an amount not exceeding 2,000 Baht per item, subject to Section 18.
11. Payment
11.1 Payments relating to Transactions on the Platform are processed through third-party payment providers and channels.
11.2 Supported payment methods may include:
(a) credit or debit card, subject to card type acceptance by third-party processors;
(b) bank transfer;
(c) other payment channels such as True Money, ShopeePay or additional methods made available by SASOM.
11.3 SASOM does not retain your full payment card information.
11.4 If a Transaction fails or payment cannot be completed, SASOM will process refunds in one of the following forms, depending on User choice and eligibility:
(a) cash transfer to a bank account;
(b) credit back to the original payment card;
(c) SASOM voucher or credit, subject to SASOM Policies. SASOM will refund the actual amount paid by you.
11.5 For cash refunds, SASOM will transfer funds only to bank accounts registered in the User’s profile under “bank account”. SASOM is not responsible for any damage arising from incorrect bank information provided by the User.
11.6 For sales made via the Platform, the Seller’s payout will equal the sale price minus Service Fees and other applicable fees (such as payment fees). SASOM will transfer payouts only to bank accounts registered in the Seller’s profile under “bank account”. SASOM shall not be responsible for any damage arising from incorrect bank account information provided by the Seller.
11.7 SASOM shall not be liable for damage arising from transmission of payment information or from incorrect or incomplete payment information entered by Users.
11.8 To verify cards, SASOM may deduct a small amount and will promptly refund this amount thereafter.
12. Membership System, Rewards, SASOM Tier and SASOM Points
12.1 Users may be eligible to receive SASOM Points and SASOM Tier Points for various activities, including purchases, sales and participation in campaigns and activities, as determined by SASOM at its sole discretion. Unless otherwise stated, participation is automatic.
12.2 Benefits associated with SASOM Tiers and SASOM Points have no cash value and may not be sold, transferred or exchanged for cash.
12.3 Users may redeem certain benefits by submitting requests to SASOM, subject to rules and conditions determined by SASOM. If a redemption Transaction fails, SASOM may return equivalent benefits but will not convert benefits into cash in any circumstances.
12.4 SASOM Points redeemed for benefits will be deducted from the User’s SASOM Points balance. Remaining SASOM Points may have individual expiry dates; Users may check details under their Accounts.
12.5 In the event of a dispute regarding SASOM Points or SASOM Tier Points that a User has received or should have received, the User must notify SASOM within fifteen (15) days from the relevant activity date. SASOM may request supporting documentation from the User.
12.6 SASOM does not guarantee and assumes no responsibility for any tax consequences arising from the use of benefits. Users are solely responsible for assessing and declaring any tax obligations and should consult their tax advisors as necessary.
12.7 SASOM reserves the right to:
(a) cancel the membership system, rewards program, SASOM Tier and SASOM Points at any time at its sole discretion, with at least thirty (30) days’ advance notice; and
(b) cancel or suspend a User’s right to participate in such systems without prior notice where actions fall under Section 6 or otherwise violate SASOM Policies.
13. Cancellation, Exchange, Return and Refund
13.1 Users may cancel Bid Orders and Ask Orders at any time prior to matching. Once a Bid Order or Ask Order is matched and a Transaction is formed, it may not be cancelled by the User except in accordance with these Terms or applicable law.
13.2 Users may not cancel Buy Orders and Sell Orders once placed and matched.
13.3 SASOM generally has no policy to exchange products unless expressly stated on the product detail page.
13.4 A User may return a product and request a refund only if:
(a) the product is in perfect condition and all SASOM tags remain intact; and
(b) the User reasonably believes that the product received is not as described in the order and/or is counterfeit; and
(c) SASOM verifies that the User’s claims are accurate; and
(d) the User notifies SASOM within three (3) days of receiving the product through the channels specified by SASOM.
13.5 SASOM reserves the right to cancel a Transaction between Buyer and Seller if it is proven that one or both parties have violated SASOM’s terms or policies, including but not limited to sending the wrong product, sending counterfeit goods or engaging in bad-faith transactions. In such case, SASOM may remedy the Buyer by means of a refund and/or other benefits at SASOM’s discretion. SASOM reserves the right to amend or cancel such remedies or policies without prior notice.
14. Delivery
14.1 For domestic shipments within Thailand and other countries where SASOM operates, SASOM will use or coordinate with leading shipping service providers or SASOM’s own delivery personnel.
14.2 For international Transactions, the User understands and agrees that products identified as being shipped from abroad are sold by Sellers located outside the Buyer’s country. Import and export of such products are subject to the laws and regulations of the relevant countries. Users are responsible for understanding and complying with applicable import/export restrictions and acknowledge that SASOM does not provide legal advice and is not liable for risks or liabilities relating to import/export.
15. Disputes
15.1 In the event of any issue arising from a Transaction, the Buyer and Seller shall first attempt to resolve the dispute through good-faith discussion. SASOM will make reasonable efforts to facilitate resolution but is not obligated to act as mediator or arbitrator.
15.2 Each Buyer and Seller confirms and agrees not to commence legal proceedings or file claims against SASOM or SASOM’s affiliated companies in relation to Transactions conducted on the Platform or disputes related thereto, except in cases where SASOM or its affiliates are the seller or distributor of the relevant product.
16. Notices
16.1 SASOM may give notices to Users by any of the following means:
(a) electronic communications, including email, SMS or in-app messages;
(b) communications via social media or other electronic channels (including Line, Facebook, Instagram, Twitter, TikTok and similar);
(c) postal mail to the address provided by the User.
Notices sent electronically shall be deemed received on the date of transmission. Notices sent by post shall be deemed received two (2) days after posting, unless otherwise required by law.
16.2 Users may provide feedback or contact SASOM through the “Contact Us” page or other channels indicated on the Platform.
17. Disclaimer
17.1 SASOM does not warrant that the Platform or any services or functions will be available, accessible, uninterrupted, timely, secure, complete or error-free at all times. SASOM does not guarantee that any issues or defects will be corrected. SASOM does not guarantee that the Platform or its servers are free from viruses, time bombs, trojans, worms, spyware or other malicious code or components.
17.2 Users acknowledge and agree that all risks arising from use of the Platform and services are borne by the Users to the maximum extent permitted by applicable law.
17.3 SASOM’s data visualization tools, charts and other analytical features, including price indices and market insights, are provided for reference only. SASOM does not recommend making Transactions based solely on such tools without independent judgment. SASOM shall not be liable for any losses arising from decisions made based on such tools.
17.4 Size charts presented on the Platform are generic brand size charts. Specific models or products may deviate from such charts. Size charts are provided for guidance only, and SASOM shall not be liable for any damage resulting from reliance on such size charts.
18. Exceptions and Limitations of Liability
18.1 To the maximum extent permitted by applicable law, in no event shall SASOM be liable, whether in contract, tort (including negligence), strict liability, product liability or otherwise, for any:
(a) loss of use;
(b) loss of profit;
(c) loss of income or revenue;
(d) loss or corruption of data;
(e) loss of goodwill;
(f) failure to realize anticipated savings;
in each case, whether direct, indirect, incidental, special or consequential, arising out of or in connection with your use or inability to use the Platform or services.
18.2 Your sole and exclusive right in relation to any dissatisfaction with the Platform or services is to cancel your Account and/or cease using the services.
18.3 SASOM’s total aggregate liability to you or any third party, in all circumstances, whether arising under contract, tort, statute or otherwise, shall not exceed the lesser of:
(a) the actual direct damages suffered by you; or
(b) 2,500 Baht.
19. Link to External Parties
19.1 Links to third-party websites, services or resources appearing on the Platform are provided for convenience only and are not under the control of SASOM. You access such websites or resources at your own risk. SASOM is not responsible for the content, accuracy or security of any linked site, nor for any changes or updates thereto, and shall not be liable for any loss or damage arising from your use of third-party sites.
20. User Content and License
20.1 “User Content” includes any text, images, photographs, videos, product descriptions, reviews, comments and other material that you upload, submit or otherwise make available on or through the Platform.
20.2 You represent and warrant that you have all necessary rights and permissions to submit User Content and that such User Content does not infringe any third-party rights and does not violate applicable law or these Terms.
20.3 By submitting User Content, you grant SASOM a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display and create derivative works from such User Content for purposes related to operating, improving, promoting and securing the Platform and services.
20.4 SASOM may remove, edit, restrict or disable access to User Content at any time if SASOM considers that such content violates these Terms or applicable laws, or in order to protect SASOM or third-party rights.
21. Force Majeure
21.1 SASOM shall not be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay is caused by events or circumstances beyond its reasonable control, including but not limited to: natural disasters, war, terrorism, civil unrest, strikes, labor disputes, governmental action, changes in law, epidemic or pandemic, failures of utilities, telecommunications or internet services, supplier failure, logistics disruptions or significant technical incidents.
21.2 In case of a force majeure event, SASOM’s obligations shall be suspended for the duration of the event to the extent permitted by law.
22. Governing Law, Jurisdiction and Changes to Terms
22.1 These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to conflict-of-law principles.
22.2 Any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Thailand, unless mandatory law provides otherwise.
22.3 SASOM may amend or update these Terms from time to time. The updated Terms will be published on the Platform with a revised “Last updated” date.
22.4 Where required by law or where changes are material, SASOM will provide additional notice via appropriate communication channels. Continued use of the Platform after such changes take effect shall constitute your acceptance of the revised Terms.
